Please read the following terms of use, which apply to every user of the ucm.jobs app (hereinafter referred to as "App"). By using this App, you declare your agreement with these terms of use. The owner of the App reserves the right to change, delete, or add to the information in this App at any time without prior notice.
The following terms apply to the use of the ucm.jobs application (hereinafter referred to as "App"), which is provided by uCastMe GmbH, represented by its managing director (hereinafter "we" or "UCM"), for you as a user of this App. For using the App, it is important that you, as a user, accept the following provisions.
By using the app, you agree to its terms of use. By agreeing, you guarantee that you will not create any content that violates these terms.

The app generally has 24-hour availability. However, interruptions in availability may occur due to maintenance required for the app/system. Interruptions in availability may also occur due to force majeure or other causes for which UCM is not responsible.
UCM points out that
If we offer discussion forums on the app, either temporarily or permanently, as a participant in these forums, you are expected to observe the usual communication rules, such as mutual respect. Visitors may not disseminate or publish offensive, potentially derogatory, vulgar, objectionable, defamatory, or obscene materials, or materials that infringe the intellectual property rights of third parties.
When you send UCM's app or emails, text messages, WhatsApp messages, or other communications from your computer or mobile device to us, you are communicating with us electronically. We will communicate with you electronically in various ways, for example, via email, text messages, WhatsApp messages, or by posting electronic messages or other communications on our app. For contractual purposes, you agree to receive electronic communications from us and that all consents, notices, disclosures, and other communications that we provide to you electronically do not require written form, unless mandatory legal provisions require a different form of communication.
All content contained in or provided by a UCM service, such as text, graphics, logos, button icons, images, audio clips, digital downloads, and data compilations, is the property of UCM or of third parties who supply content or make it available in the app, and is protected by German copyright and database law.
The entire content contained in or provided by UCM's app is exclusively the property of UCM and is protected by German copyright and database law.
You may not systematically extract and/or reuse parts of a UCM service without our express written consent. In particular, you may not use data mining, robots, or similar data gathering and extraction programs to extract any substantial parts of a UCM service for reuse (whether once or multiple times) without UCM's express written consent. Furthermore, you may not create and/or publish your own database containing substantial parts of a UCM service without UCM's express written consent.
Access to the main services of the app requires the creation of a profile.
To create a profile with UCM, you must provide a valid email address, choose a password, and provide your current mobile phone number. To verify your phone number, you will receive a confirmation code via SMS during the registration process. By subsequently clicking the "Register" button in the app, you submit an offer to conclude the contract for the use of the app and agree to UCM's data protection regulations valid at the time of your registration.
UCM accepts this offer by sending you an activation email to the email address you provided during registration. By clicking on the activation link, a contract for the use of the app ("Usage Agreement") is concluded between you and UCM. We reserve the right to reject your registration without stating reasons.
By creating a profile, you also allow UCM to contact you regarding current and/or new job offers. You can revoke this consent at any time.
You agree not to provide false information about yourself. Furthermore, you agree to regularly check your information to ensure its accuracy.
When you use the UCM app, you are responsible for maintaining the confidentiality of your profile and password, and for restricting access to your computer and/or mobile devices. To the extent permitted by applicable law, you agree to be responsible for all activities that occur under your account or password. You should take all necessary steps to ensure that your password is kept confidential and secure, and you should inform us immediately if you have reason to believe that a third party has gained knowledge of your password, or if the password is being used without authorization, or is likely to be. You are responsible for ensuring that the information you provide to us is accurate and complete, and that you notify us of any changes to the information you have provided. You can view and update all information you have provided to us in the app at any time.
You may change your password in the app at any time.
You may not use the app in any way that could interrupt, damage, or otherwise impair UCM's services or access.
Furthermore, you may not use UCM's services for fraudulent purposes or in connection with a criminal offense, illegal activities, harassment, or inconvenience.
You may only maintain one profile in the app at any time. Should you nevertheless register multiple times and simultaneously possess several profiles, we will delete all your user accounts except for your oldest profile. We reserve the right to delete all your profiles.
We reserve the right to withhold your services in the app or deactivate your profile. This applies in particular if you violate applicable law, contractual agreements, or our policies, or if we can no longer reach you via the email address and, if applicable, phone number you provided, or if we receive no response from you.
As a user of the app, you can deactivate and delete your profile at any time by sending us a corresponding message (in writing or electronically). The period for deleting the profile from the app is one billing month, to ensure that any outstanding billing can be processed smoothly. You are solely responsible for downloading the relevant billing documents in time before your profile is deleted.
After successful registration and activation of your profile, we reserve the right to conduct a telephone introductory call with you in order to display suitable employment offers from companies (hereinafter "Job Offers") in the app.
The job offers initially represent non-binding information, and applying for such a job offer does not necessarily guarantee a successful outcome.
You can only apply for a job offer once you have completed all relevant information in your profile, and have uploaded your enrollment certificate and, if applicable, work visa, and these have been verified by us.
The UCM app will display jobs that match the information in your profile (e.g., preferred cities, language skills, preferred job types, etc.). You can change and/or adjust these settings in your profile at any time. You can apply for a job offer by clicking the "Apply" button in the view of the respective job offer.
Subsequently, the client and/or project manager has the option to accept you for the job and send you an assignment order. As a next step, you are required to confirm the job in your profile. If you do not confirm the assignment order at least 24 hours before the job starts, we reserve the right to withdraw your application and the assignment order. This will terminate the process at this point, and an employment contract will not be concluded. (You are not obliged to perform any work, but you will also not receive any remuneration)
If your confirmation is successful, you have sent us a binding offer to which you are bound. With this confirmation, you will automatically receive a [document/item] from UCM
a signed employment contract will be sent to you, which you can download from your profile at any time. You must return this signed contract to us by mail; the contract will be concluded upon our acceptance.
You will commence your employment with the respective company on the agreed date. You will receive this information through a briefing, which will be made available to you in your profile and which you must confirm before starting the job.
Information relevant to the performance of the respective job, including your consequences and obligations in case of illness or similar, can be found in the corresponding employment contract.
To prevent and/or mitigate damages, you are primarily responsible for preventing avoidable harm to yourself and third parties, using the control options we provide for managing your profile.
In all disputes between you and third parties related to the user content you provide, you are solely responsible for the legality of the content you use. Should third parties assert claims against UCM, you shall indemnify UCM against any resulting third-party claims. This does not apply if you are not responsible for the infringement.
You are obliged to immediately, truthfully, and completely provide UCM with all information that may be necessary for the examination of claims and a defense in the event of a claim by third parties. You shall bear all reasonable costs incurred by UCM due to an infringement of third-party rights, including the reasonable costs incurred for legal defense.
The collection, processing, and storage of personal data by UCM is carried out exclusively in accordance with the provisions of German data protection law and the European General Data Protection Regulation. Furthermore, regarding your consents and additional information on data collection, processing, and use, please refer to the privacy policy, which is available on UCM's website at any time.
UCM respects the intellectual property rights of third parties. If you believe that your intellectual property rights have been used in a manner that gives rise to concern about an infringement, please follow our procedure for notifying UCM of an infringement.
We always strive to ensure that UCM's services are available without interruption and that transmissions are error-free. However, due to the nature of the internet, this cannot be guaranteed. Your access to UCM's services may also be occasionally interrupted or restricted to allow for repairs, maintenance, updates, or the introduction of new facilities. We endeavor to limit the frequency and duration of any such temporary interruptions or restrictions.
UCM is liable without limitation insofar as the cause of damage is based on an intentional or grossly negligent breach of duty by UCM or a legal representative or vicarious agent of UCM.
Furthermore, UCM is liable for the slightly negligent breach of essential obligations. Essential obligations are those whose breach jeopardizes the achievement of the contract's purpose or whose fulfillment is essential for the proper execution of the contract and on whose observance you regularly rely. In this case, however, UCM is only liable for foreseeable, typical contractual damages. UCM is not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.
The foregoing limitations of liability do not apply in cases of injury to life, body, or health, for a defect after the assumption of a guarantee for the quality of the product, and for defects fraudulently concealed. Liability under the Product Liability Act remains unaffected.
To the extent that UCM's liability is excluded or limited, this also applies to the personal liability of employees, representatives, and vicarious agents.
These General Terms and Conditions and the user agreement governed therein are subject to German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
